Has Article 370 been Scrapped? ================================ இல்லை, அதாவது இன்னும் இல்லை. பிரிவு 370 இன்னும் நீக்கம் செய்யப்படவில்லை. பிரிவு 370 உட்பிரிவு(1)(c) படி பிரிவு 370ஐ வெறுமனே ஜனாதிபதி ஆணையின் மூலம் நீக்கவும் முடியாது. Condition Precedent: காஷ்மீர் அரசியல் நிர்ணய சபையின் (Constituent Assembly of Kashmir) பரிந்துரையின் மூலம், நாடாளுமன்றத்தில் பிரிவு 368 கூறும் வரையறையின் படி தான் நீக்க முடியும். (the provisions of article 1 and of this article shall apply in relation to that State) பிரிவு 370 உட்பிரிவு 1(d) படி அரசியலமைப்பின் மற்ற கூறுகள் காஷ்மீருக்கு ஏற்றவாறு ஜனாதிபதி உத்தரவு/ஆணையின் மூலம் மாற்றி செயல்படுத்தலாமே ஒழிய பிரிவு 370ஐ முற்றிலுமாக மாற்ற முடியாது.
